Transpersonal Psychology is a branch of psychology that is concerned with the study of those states and processes in which people experience more depth and breadth of who they are, or a greater sense of connectedness with others, nature, or the spiritual dimension. The term ‘transpersonal’ means ‘beyond the personal’ and a common assumption in transpersonal psychology is that transpersonal experiences involve a higher mode of consciousness in which the ordinary mental-egoic self is transcended. Transpersonal Psychology is a relatively new development in academic psychology that has yet to be recognized formally by the American Psychological Association. Transpersonal Psychology has very little, if anything, to do with crystals, UFOs, alien abductions, chakras, auras, angels, psychism, aromatherapy, levitation, fire walking, or the millennium, except as these phenomena, practices or experiences may be investigated in terms of their transformational consequences.Although many would argue this point, Transpersonal Psychology is not metaphysics. This leads to a problematic viewpoint, because many would claim that transpersonal experiences imply a metaphysical belief in a spiritual, divine, or transcendent realm. However, there are some transpersonal psychologists who understand the transpersonal in more immanent terms, for example the developing of a greater sense of connectedness with the deeper Self, the world of nature, or the social, interpersonal dimension. In practice it is important that transpersonal psychologists are clear and open about their own metaphysical assumptions.Transpersonal Psychology does not denounce rationalists. Although it can be argued that the highest states of transpersonal consciousness are ineffable and beyond a rational appreciation, Transpersonal Psychology does not dismiss or devalue rational and intellectual analysis, which can add much to our knowledge and understanding in these areas. This article describes 12 recurring problems with commercial real estate loans that commercial borrowers and their advisors need to anticipate before it is too late. The following problems are common in traditional bank commercial real estate loans and should be avoided if feasible (special circumstances will periodically make some of these terms unavoidable).COMMERCIAL REAL ESTATE LOANS PROBLEM NUMBER 1: Tax Returns versus Stated IncomeMost traditional banks will require several years of tax returns in order to qualify for a commercial real estate loan. The alternative is to use a Stated Income lender that does not verify personal income or assets. Many borrowers will simply not qualify for a commercial mortgage loan if tax returns are used due to high business expenses (and low net income). Many lenders using tax returns will also continue to verify income after the loan closes. Seasoning of ownership is similar to seasoning of funds, except this requirement involves the minimum time someone has owned a commercial property before they can refinance the property.COMMERCIAL REAL ESTATE LOANS PROBLEM NUMBER 9: Requirement to sign IRS Form 4506IRS Form 4506 authorizes the lender to obtain a borrower’s tax returns directly from the IRS. This form is routinely required by most traditional banks and many other commercial lenders for a business acquisition loan. Commercial borrowers using a Stated Income lender with limited documentation requirements will avoid this requirement.COMMERCIAL REAL ESTATE LOANS PROBLEM NUMBER 10: Debt Service Coverage Ratio (DSCR) in excess of 1.2 for a business acquisition loanThe most flexible approach to DSCR for a commercial property loan will require a DSCR in the range of 1 to 1.2, with exceptions permitting a DSCR less than 1.COMMERCIAL REAL ESTATE LOANS PROBLEM NUMBER 11: Minimum commercial property loan size that is too high for your commercial mortgage needs. Employment – Do You Know Your Rights?

Do you know your rights?Your rights are governed by your contract of employment and by the law. Your contract does not have to be written. But, if you are an employee, once you work for your employer continuously for 2 months, you are entitled to a written record of the most important terms of your employment. Generally, employees have more legal protection than the self-employed. There is no precise, legal, definition of these terms. All the circumstances, and especially the overall picture they paint, are relevant. Generally speaking, you are more likely to be an employee if you have to do your duties personally, if your employer can tell you how to do your job, and if you cannot work for more than one employer at any given time.Minimum rightsYour contract may be in a letter or a formal agreement. It may even be verbal. Normally, at least some rights will be written. If an employee, you are entitled to receive a written statement of the most important terms of your employment.The law sets certain minimum rights. Your employer cannot give you less than what the law offers. If you did not agree to certain matters, your legal rights will apply automatically.
